If you have a matter in Bankruptcy Court that requires attorney representation in an adversary proceeding or contested matter, whether you are a Debtor or Creditor, we can likely assist you. Even if you have an existing attorney in Bankruptcy Court, check with them and they will let you know if they are able or willing to represent you in a matter that is not the same as the main case.
We are able to represent Creditors (individuals or businesses) for the following services:
Proofs of Claim:
- Either in asset Chapter 7 cases.
- or Chapter 13 cases o If the Debtor owes you money or you otherwise have a claim (liquidated and non-contingent) against the Debtor, you will not be paid money that is earmarked for creditors unless you file a Proof of Claim with the Court that is proper.
Objections to Plan:
- If you are a Creditor, your rights may be affected by what the Debtor provides for you in their Chapter 13 Plan.
- If you do not object, in many instances, you may waive your right to object or change the terms later.
Rule 2004 Exams:
- If you are a Creditor, and are considering or have reason to believe you may have grounds to set aside the debt the Debtor owes to you, it is important to request additional examination of the Debtor over and above the Section 341 Meeting of Creditors.
- Provides you separate and one-on-one examination of the Debtor (with their counsel if Debtor is represented).
Section 341 Meeting of Creditors:
- If you are a Creditor, you may consider hiring counsel to attend the 341 meeting of the Debtor to either observe or ask questions of the Debtor.
- You will have the opportunity to ask some questions but will not be allowed to take too much time as other cases will be on the Trustee’s docket.
- Opportunity to assess Debtor under oath to gauge honesty and credibility of Debtor to determine appropriateness of any further action.
