Bankruptcy Code Section 523 – Dischargeability Actions
Budgen Law represents both Debtors in defending Section 523 actions or bringing a dischargeability action against a Debtor on behalf of a Creditor.
A Section 523 action means a creditor is asking the court to determine and decide if a particular debt owed to a specific creditor by the Debtor should not be allowed to be discharged with the rest of the unsecured debts that are otherwise dischargeable. There are limited and specific grounds for the Judge to rule that a debt is not dischargeable. That means the debt survives bankruptcy and the creditor may pursue collection of its un-discharged debt after the Debtor emerges from bankruptcy.
