Bankruptcy Code Section 727 – Denial of Discharge
Budgen Law represents Debtors in defending Section 727 denial of discharge actions brought by Creditors or the Trustee.
A Section 727 action against a Debtor is more serious and concerning than a Section 523 action. Instead of a single creditor bringing an action against the Debtor to contest the dischargeability of one debt, the party bringing the Section 727 action is seeking to deny discharge of all debts. That party is alleging that the Debtor’s failure to do something required by the rules, or the Debtor’s actions which violates the rules, should deprive the Debtor of any bankruptcy relief. It is a serious matter and a Debtor should seek representation.
Additionally, although bankruptcy court is a civil (non-criminal) venue, a Section 727 action against a Debtor may sometimes lead to the creditor or party making a referral to the U.S. Attorney’s Office or the Department of Justice (FBI) for criminal investigation and prosecution.
