All bankruptcy attorneys are attorneys, but not all bankruptcy attorneys are litigation or trial attorneys. You would not use a general practice physician to perform your emergency appendectomy or open-heart surgery. Not that the GP would do that even if you asked and wanted him to. It is the same with bankruptcy litigation – many bankruptcy attorneys will not or do not represent clients in litigation matters because they do not possess the expertise to do so.
If you are sued in your bankruptcy case, it does become a separate case and your attorney is not compelled by law to represent or defend you in that matter unless previously agreed upon.
